Child Support Enforcement Agency Reporting Service updates

The ISO ClaimSearch CSEA program includes the Child Support Lien Network (CSLN) program and the federal Office of Child Support Enforcement (OCSE) program. Companies can participate in one or both of these child support intercept services.

Kansas
Kansas has joined the Department of Health and Human Services Office of Child Support Enforcement (OCSE) program, bringing the total number of participating states and jurisdictions to 52. ISO has added Kansas to the ISO ClaimSearch® OCSE program for participating companies.

When you submit casualty claims for claimants residing in those jurisdictions, the system will automatically check the claimant names against the OCSE database of delinquent child support obligors. If there is a match, the system will send the claim to the OCSE, which will refer the claim to the appropriate state child support enforcement agency. That agency may, at its discretion, place a lien on your settlement of the claim.

If you participate in all states, we’ll add Kansas automatically to the searches for your company’s claims. If you don’t participate in all states, you may add the new ones to your list of participating states by completing an ISO ClaimSearch CSEA/OCSE Authorization Form.

Texas
Effective June 19, 2009, the Texas Legislature amended the state’s Texas Family Code. The amendment requires that all insurers doing business in Texas provide information to the Child Support Division of the Office of the Attorney General to help improve the enforcement of child support. The agency will consult with the Texas Department of Insurance and representatives of the Texas insurance industry and provide procedures, including data matches, to identify child support obligors and intercept certain liability insurance settlements or awards for claims to satisfy arrearages.

Companies can satisfy the reporting requirement by participating in the Child Support Lien Network (CSLN) program. The program will help identify delinquent obligors whose claims may be subject to a child support lien.

When you submit casualty claims to ISO ClaimSearch, the system will check the claimant names against the CSLN database of delinquent child support obligors, which includes information from Texas and 29 other participating state enforcement agencies. If there is a match, the system will send the claim to the CSLN, which will refer the claim to the appropriate state child support enforcement agency. That agency may, at its discretion, place a lien on your settlement of the claim.

Your company can participate in the CSEA/CLSN service for one, several, or all states. There is no cost to insurers or self-insureds to participate.

NOTE: We have added participation in Texas for all companies participating in the CSLN program to comply with the Texas reporting requirement. If your company doesn’t wish to participate in Texas, please contact ISO ClaimSearch Customer Support to opt out of participation in this state.
